Terms of Service for Plant Hero
Effective Date: 2025-07-15
1. Acceptance of Terms
By downloading, accessing, or using the Plant Hero application ("Application"), you agree to be bound by these terms. If you do not agree, do not use the Application.
2. License Grant and Restrictions
George King ("Licensor") grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on any Apple-branded devices that you own or control, solely as permitted under the Apple App Store Usage Rules. You may not copy, reverse-engineer, disassemble, distribute, sublicense, or create derivative works of the Application.
3. Subscriptions
Some features may require a subscription ("Premium"). By purchasing Premium, you agree to pay all applicable fees through your app store provider. Subscriptions renew automatically unless cancelled in accordance with the store’s policies.
4. Premium Features and Fair Use
Premium includes ad removal and up to 30 daily AI-powered plant identification scans. We may impose fair use limits or rate restrictions to maintain system stability and prevent abuse.
5. Plant Identification Accuracy
We do not guarantee 100% accuracy in identification results. Results are informational only. Consult a professional before making decisions about edible, toxic, or medicinal plants.
6. Disclaimer of Responsibility and User Assumption of Risk
THE PLANT HERO APPLICATION IS PROVIDED FOR GENERAL INFORMATIONAL PURPOSES ONLY. ALL CONTENT, INCLUDING AI-GENERATED RESPONSES, IMAGE ANALYSIS, PLANT IDENTIFICATION RESULTS, AND SUGGESTED ACTIONS, IS PROVIDED “AS IS” WITHOUT WARRANTY OR GUARANTEE OF ACCURACY, SAFETY, OR SUITABILITY FOR ANY PURPOSE.
UNDER NO CIRCUMSTANCES DO PLANT HERO, GEORGE KING, OR ANY AFFILIATED INDIVIDUAL OR ENTITY ACCEPT ANY LIABILITY FOR ANY ACTIONS TAKEN BY USERS BASED ON INFORMATION PROVIDED BY THE APPLICATION. THIS INCLUDES, BUT IS NOT LIMITED TO, EATING OR HANDLING PLANTS, INGESTING ANY SUBSTANCE, OR USING PLANT-RELATED DATA FOR MEDICAL, VETERINARY, OR TOXICOLOGICAL PURPOSES.
BY USING THE APPLICATION, YOU EXPRESSLY AGREE THAT YOU ALONE ARE FULLY RESPONSIBLE FOR VERIFYING ANY INFORMATION BEFORE TAKING ANY ACTION. YOU WAIVE ANY RIGHT TO CLAIM DAMAGES, COMPENSATION, OR LIABILITY AGAINST PLANT HERO OR GEORGE KING IN CONNECTION WITH THE USE OF THE APPLICATION, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
YOU FURTHER AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS PLANT HERO AND GEORGE KING FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR LIABILITIES ARISING FROM OR RELATED TO YOUR USE OR MISUSE OF THE APPLICATION OR RELIANCE ON ITS CONTENT.
7. Intellectual Property
The Application and its contents (excluding user-uploaded content) are the intellectual property of George King. No part may be copied, redistributed, or reused without written permission.
8. Third-Party Services
The Application integrates third-party services such as Google Gemini, AdMob, and RevenueCat. These services are governed by their own terms and policies. We are not responsible for their accuracy, reliability, or handling of data.
9. User Content
By uploading plant photos, you consent to their transmission to Google’s Gemini AI models for the purpose of plant identification. These images may be stored and processed by Google. You retain ownership, but photos may not be deletable after submission. Do not upload images you are not authorized to share.
10. Termination
We reserve the right to suspend or terminate access to the Application for violations of these terms or abuse of the service.
11. Disclaimer of Warranties
The Application is provided “as is” and “as available” without warranties of any kind. We disclaim all express or implied warranties including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the fullest extent allowed by law, Plant Hero and George King are not liable for indirect, incidental, or consequential damages, including data loss or personal injury, even if advised of the possibility of such damages. Total liability will not exceed fifty US dollars ($50).
13. Export Restrictions
You agree not to use or export the Application in violation of applicable laws, including U.S. export laws. You represent you are not in an embargoed country or on a restricted list.
14. Apple Supplemental Terms
This agreement constitutes a Custom End User License Agreement between you and George King. Use of the app is also subject to Apple’s Licensed Application End User License Agreement, available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In the event of a conflict, this Custom EULA prevails unless otherwise prohibited by law.
15. Governing Law
This agreement is governed by the laws of the United Kingdom. You agree to the exclusive jurisdiction of the courts of England and Wales.
